Terms and Conditions for Alba Cottage, Craighouse, Isle of Jura.
Property owners Alex and Carolyn Dunnachie
Alba Cottage is let under Section 12(2) and Para. 8 Schedule 4 of the Housing (Scotland) Act 1988. This means that it is to be used for holiday lets only and may not be sub-let. The maximum number of visitors permitted is five, this number is inclusive of children.
Booking
To make a booking please return a fully completed booking form with your deposit to
Alex Dunnachie, Croft 3, Keils, Isle of Jura, Argyll. PA60 7XG
Cheques should be made out to Alex Dunnachie.
The standard non-refundable booking deposit is £100.00.The full cost of the let is payable six weeks before the holiday. Bookings made within six weeks of the arrival date require full payment. The £100.00 booking deposit reverts to a good house keeping deposit, The property should be left in the same condition as found or a portion of the £100.00 may be retained for damages, breakages or extra cleaning should there be any, if not then it will be returned within 1 week of your departure, we do not charge for small breakages of crockery or glasses etc but do ask that you inform us so they can be replaced for new guests coming in to the property.
Dogs
Dogs may be allowed by special arrangement with the owners.
Payment
No booking is binding until confirmed by email or in writing by the Owners after receipt of your completed booking form and deposit. All bookings are subject to these terms and conditions. The booking form signed by you together with our acceptance of your deposit constitutes a contract. The owners reserve the right to refuse a booking without giving a reason.
The balance is due six weeks before your arrival date.
Non-payment of the balance of the holiday let on, or before, the due date shall be construed as a cancellation of the contract by the holiday maker.
The Period of Let
The letting period runs from 3.30p.m. on the day of arrival to 10.00 a.m. on the day of departure.
The cottage is let with bed linen and hand towels provided. Used bed linen and hand towels should be placed in the bath on the day of departure. Bath towels can be provided for a small additional fee.
Cancellation
Notice to cancel a booking must be in writing and sent by recorded delivery. Where written notice of cancellation is received more than six weeks from the arrival date only the deposit is forfeited. If written notice of cancellation is received less than six weeks from the arrival date, or if the let is cancelled due to non payment, the full letting charge is due.
We shall not be liable for any cancellations, changes, effect on your holiday, loss or damage suffered by you, or any member of your party, You are advised to take out holiday insurance.
The lessor shall not be responsible for any death, personal injury to the hirer or any person named in the booking form or other person at the property or damage sustained to their property during the letting period..The hirer warrants that the subjects let are to be used for the purposes of a holiday and so accepts that the letting is a holiday let to which Section 12(2) and paragraph 8 of Schedule 4 of the Housing (Scotland) Act 1988 apply, namely, “ a tenancy the purpose of which is to confer on the tenant the right to occupy the house for a holiday. ”The hirer shall not sub-let the property or any part thereof. The hirer binds and obliges himself/herself to vacate the hired premises without demand at the termination of the letting period The hirer binds and obliges himself/herself to pay the lessor in respect of any loss or damage beyond fair wear and tear. The hirer shall undertake to prevent any member of his/her party from causing a nuisance or disturbance to neighbours. The hirer undertakes to leave the hired premises secure if left unoccupied during the period of let. The hirer undertakes to relieve the lessor from any liability for damage or injury however caused by any member of his/her party. The lessor accepts no responsibility for loss, injury or damage to any member of the hirer’s party or their property arising in any manner out of the let of the premises.
